Westgate Timeshare – Experience of a Former Owner

The following post was submitted by a couple detailing their experience as Westgate timeshare owners, and why they decided to stop paying their Westgate timeshare.

In 2005, we purchased a Timeshare from Westgate Resort in good faith. We were a young married couple with two toddlers. We were told that we would never regret the purchase and that we had a “lifetime of amazing vacations” ahead of us. The only thing that has remained constant and true is the fact that WE HAVE REGRETTED EVERY MINUTE OF OUR PURCHASE.

Between 2007 and 2010, we paid two different companies over $2,000 who each claimed that they guarantee to sell our timeshare. Neither ever did. In 2010, we contacted Westgate and notified them that we would NO LONGER be cheated out of our hard earned money and would NOT continue to pay them. They did not care that we had paid thousands of dollars to them already (100% on time) or that we had spent over $2000 to companies to sell our timeshare. The only thing they cared about was getting their money. They even acknowledged that purchasing a timeshare may not have been the most “honest” purchase but that we were never “forced” to do so.

On December 1, 2011, we will STOP PAYING our timeshare and to NO LONGER allow Westgate to cheat us out of our hard earned money every month. We have impeccable credit of which we have lived an honest and hard working life to establish. Now, it will be ruined for 7 years, at least, due to this foreclosure.

This decision was not easy for us to make, but also one that was based on principle. It is NOT RIGHT for companies such as Westgate to be allowed to misguide trusting people into making such a bad investment. It is even more wrong for consumers like us who have led decent and hard working lives to provide our children with the American dream, to have to suffer ruining their credit due to such a cheating and unethical process such as purchasing a timeshare.

We only owed approximately $6,500 at the time we decided to stop paying. However, we vowed NEVER TO ALLOW WESTGATE TO CHEAT US OUT OF ANOTHER ONE OF OUR HARD EARNED CENTS AGAIN. Our children deserved better than that.

  2. Iwas told yesterday my deed at lieu was rejected by Westgate. Unit paid off owe maintenance fees only
    Lady very rude and keep contradicting herself..but willing to sell me another unit
    .I explained my situation she was like it’s life lady I’m on dylasis. I can’t afford it…I am willing to give it backand I haven’t ever used it…she calls all day long. Any advice she also said she was putting a judgement one if I don’t call her by 3 today.I get a small check I can’t work what should I do

  3. Tom again: Just reading these comments it seems like the answer is right in front of your eyes. You don’t need to wait for a class action lawsuit. It hasn’t happened. What will hurt these scammers the most is to put them out of business. Imagine what happens if you all stop paying? You do have the power to stop this now. They really do give up eventually just like in my case. Get off the fence and stand up for yourselves! Stop paying and no contact!! Relax like those of us who have already paying.

  4. We recently received a certified letter in the mail from Greenspoon Marder Law, it is a notice of default and intent to foreclose. We have not paid in almost two years, is this another tactic to get people to pay? Should we respond with anything or just let things proceed? I have never been so embarrassed and ashamed that my wife and I fell for a scam like this.
    Has anyone ever went through with the full foreclosure process with Westgate?

    1. I am thinking of stop paying these crooks also. You dais or had been two years and you still receive letters.Has your credit been affected? Do they still call you from Westgate asking about making payments?

    2. What happened with your Greenspoon Marder Law notice? We received one for not paying and I refuse to respond to it.

      1. Excellent! Don’t respond! You are almost home free. After the Notice of default, they will foreclose and you are done.

I am getting ready to stop paying for my TS as it turned out to be the most disastrous mistake that I have ever made and will forever regret but I have worked so hard to recover my own credit from previous financial hardships and I just want to be sure that it will not show up on my credit report and all my efforts be in vain. Can anyone advise

      1. I paid my mortgage in full and after 10 years of paying maintenance fees that kept rising, I told Westgate I no longer wanted my timeshare. I paid off the mortgage in 2004. In 2013 they put a foreclosure statement on my credit report, which i just found out about and will be fighting

  6. Does anyone have any updates to share regarding this matter? I am up to date and I decided to stop paying these lying scammers. WE were wrongfully mislead in so many ways, I have not even been able to use my week once!

  7. STOP PAYING THEM! Don’t pay Westgate one more dime. I have not heard yet of anyone taking a hit on their credit. Westgate used their own internal collection agency, so don’t be scared of them either. These people scam people like us for a living. For me, I would even take a hit on my credit before giving them anymore money!

      Thank you for posting on this forum. I am in the same boat, I feel I was scammed when we purchased it. We owe as of today $6,000 and I want to walk away from it. I am worried about my credit though. Did you get foreclosed and did your credit take a ding from it?

      1. Ken, you can check your credit report for free via the Federal Trade Commission’s web site link, which I think is annualcreditreport dot com. See if Westgate is even listed there.

      2. We just got denied for a home loan… we have perfect credit and make great money… except for the Westgate Time Share. It is showing as a Foreclosure on our credit. We quit pay 6 years ago… and they put the foreclosure on last month.

  8. We have been GOT. We just signed two days ago. Any quick suggestions on how to get out of this ASAP in TN. I’m finding 5 different addresses do we send the letter of rescind to all 5 addresses?

      1. I know in Florida they have a buyers remorse law for certain amount of time to get out of the contract. Check TN law to see if they have same.

    1. Yes I sent letters to all five addresses!!! You have 10 days to get out!!! They offered my wife and I a $21,000 cabin. When I told them I wanted out they came all the way down to $10,000 screw Westgate and if you’re in get out now!!!!! Much love!!!

      1. Hi, i really need big help. My husband and I purchase westgate last april of this year but we wanted to get out for we cant afford anymore to pay. Is there anything we can do about this??

        1. If 10 days have passed, which I believe it has by the date of this post. You are now responsible and proud owner of timeshare. Sorry for the sarcasm. All you can do is pay, get someone else to buy from you, rent it out, or stop paying and get foreclosed on and take the hit on your credit. You may see if they will take it back but if it’s not paid outright, that will probably not happen.

    2. I sent my letter to all 5 addresses as I also located 5. It wasn’t cheap sending 5 certified letters. I just received a response from them where they clearly failed to read my letter. I’ll be sending round 2 letters.

      1. If you sent it certified mail, that’s all you need. It may be expensive but peanuts compared to keeping it as an owner. You do the math. Also, you could have called customer service or owner services and asked where to send via e-mail or the correct address. They have to give you that info.

  9. hello there, as I read everyones comments i realized that i have been scammed by westgate. i would like some advice as to what to do next. i plan on not making any payment, even if that means hurting my credit because i rather have that happen than giving them my well earned money. thank you and i hope you respont back.

    1. You have several options, but they depend on your situation. You could walk away. Just stop paying. But you should only do this if you are unconcerned about affects to your credit. You will take a hit walking away. You could try to sell it, but there is NO COMPANY that can sell your timeshare for you. They have no value. Timeshare resale companies are a total ripoff. Beware. There are companies who claim you can donate your timeshare to a charitable organization. Another scam, I’m afraid. What charitable organization would want a worthless piece of property and assume the ongoing debt associated with it? None. Hiring a lawyer is an options. Your attorney would make the case the the timeshare company used unfair trade practices to get you to sign the contract. But it will cost you a fortune. You are stuck with it unless you have the contract cancelled legally. Do not use a title transfer company. Good luck.

I have had a buyer for my timeshare at westgate for over 2 months now. they have blocked and have made it impossible to sell so my buyer backed out after being so rudely treated by them. of course they stalled just long enough to make sure my HOA fees had to be paid. these people are thieves, rude and legally steal from working class people. there has to be a lawyer out there with enough “balls” to take them on. Come on people, I am ready to stand outside and picket, at least that will get the news involved. Is anyone else as angry as I am? We can’t just sit back and let this happen to us while they are smoking there big cigars, drinking wine and laughing at us!

    1. Unfortunately, most lawyers won’t even look at these (unless there was proof of unethical behavior such as alcohol served, recordings, etc) because it’s all legal. They paid very good lawyers to make sure all the stipulations are there. Plus the state of Florida had so many complaints, they increased the cancellation time to be 10 calendar days from the date of purchase. Just enough time to have some time to read or have it read by your attorney. If you didn’t do that but are now upset bc the bills finally came in… You don’t have many options. That’s how it is.

I purchased 2 times shares in 2009 for 32,000.00 we had a great time in the Smoky Mountains and it was only hours away from my house. indoor water park and something I could leave to my kids. 8 years later every time I call they have nothing available for the next 2 years. but yet I am still paying almost 1000 in maintenance fees. If a class action lawsuit comes up I want in.

  13. Wish I would have been visited this site before I bought with Westgate. For all the money I’m paying they could be more helpful when trying to plan a vacation. I bought last year. Trying to plan for this year. Forget that, they already have our money so they are done with helping out. Thinking about not paying…hopefully doesn’t hurt credit and tired of the run around. Let me know if there’s a class action suit…I’m in.

      1. Let me know I’m in. If we can collectively unit maybe we would have a chance I’m a senoir citizen I don’t have 7 yrs to wait for excellent credit to return it need something done now.. I’ll give then back there 4 bedroom luxury villa in Park City back no questions asked. But they will have to sit on it. Since They are going to mess me up with my short future I don’t see why I should stay the upstanding faithful owner that I have been while being lied to, ripped off year after year. Since 2003…that money could of giving me a vacation of a lifetime, not one of hurt and embarrassment.took family to our 4 bedroom luxury villa in Park City, and was so discussed I will never ever go there again period!

    2. I bought a Westgate timeshare in 2014. I stop paying on it and told them to do whatever they wish I’m not paying another fine. Guess what after eight months non payment they offered a deed in lieu of foreclosure and me to pay $500. I haven’t heard from them since, on the other hand they did take my sister to court but she won, due to there misleading practices. Good luck

  14. I concur with all of you. My husband and I purchased our WG timeshare back in 1999. Paid in full, never used but once and then only to find out we didn’t get the “actual” unit we purchased. We were excited of spending vacations with our families in future family vacations. We complained and they tried to sell us another one but at a higher cost. We are just regular “working class” people trying hard to make it through life and we’ve been duped. It saddens my heart to know that Mr. Siegel recognizes he fact that WG is a “sham” and continues to make billions in profits from it. But one day, Himself , investors and all will have to account for cheating “God’s” people. They will have to answer for their deception. They have “ripped” off hundreds of thousands of families just like us. We only wanted what was “contracted” to us. The maintenance fees are outrageous and should be illegal. I too remain torn to sign the WDILF or just continue to ignore repeated phone calls, emails, just harassing us to make a payment, put it on a card or something. We tried going through company who promised to sell and was duped again. Lord, help us. Does anyone stand for the right anymore? Is everyone chasing the almighty dollar? Now my husband was downsized, no job, over age of 50 so it’s difficult finding gainful employment. We decided to just pray over the situation ..trust God .. and believe that God will supernaturally work it out. Because He specializes in doing the impossible. We’ve tried it our way.Look at where that got us. Now we try it His way. That’s all we have and that’s all we need. I wish all of you success.

  15. Earlier is March we received a notification of foreclosure for non-payment (we were fed up with not being able to use the damn thing so we stopped paying on it). I contacted Westgate and asked for a deed in lieu of foreclosure, I received no flack from them nor did I receive any settlement offers. I was sent the paperwork to request and I did have to pay the transfer fee which was $500 but they let me pay in installments. There was no credit hit and we owe nothing else. I had a better experience with this than I did with anything else involving westgate. There is a light at the end of the tunnel:)

    1. We haven’t paid in two years. We asked to give back the timeshare (mortgage fully paid, only maintenance fees per year are due). They have refused.

      They keep sending us letters to send in our credit card statements, our medical files, pay stubs, all our debt, etc. And we continue to ignore them.

      We were just financed for several large purchase so they haven’t touched our credit rating.

      I wish they’d just take it back.

    2. I have no clue how you did it I have offered and they say No its been paid off since the day we bought it we owe one year on maintance my ex refuse to pay his part by the courts its his
      but my name is still on it they wouldn’t take my name off unless he pays and then they want 700 from me to get my name off !I have stop answering their calls which is every Tuesday and Thursday sure do hope there is a light at the end its driving me nutts

      I Westgate timeshare is fully paid off, when asking for “deed in lieu of foreclosure” did you have to pay any of the past due maintenance fee and the $500 transfer fee?

  16. We just bought a timeshare with them, after a tiring morning listening all the “benefits” we could get. We’ve being charged the initial payment only but after read all these horrible experiences of many of you; we don’t want to be scammed by them anymore.
    We’re not US residents and we don’t live at the States; so how could we do for do not being charged and cancel the business with them?. We understand they might charge us a paperwork fee; and we’re willing to pay it but we don’t want to be drawn with payments and do not get what they offered.

      It saddens me that Westgate is still strong arming people into purchasing a timeshare. I was once in your boat. The first thing you need to do is prevent Westgate from getting more money. You could cancel the card or get a new credit card number. If you are still within your 10 days of purchase you could write a letter of cancellation and get your money back. The letter has to be written and sent to a specific address. If you look through the older comments you will be able to find the address and letter. If you past the time frame I suggest that you stop any further payments. They will harass you via the phone and mail and will refuse any other solutions that do not include payment plans and keeping your condo. Eventually they will offer deed in lieu of foreclosure. It will take anywhere from 9-11 months. They will threaten to foreclose…the foreclosure is a lie.

  17. My partner and I became owners on the 25th of October 2015. We were on our first family holiday in Orlando, were offered a night in a luxury resort for free in return for taking the time share tour. We thought we had nothing to lose so we did it. We were given the hard sell, what they told us seemed to make sense. We’d spent $11000 on this dream holiday, paying $16000 for a time share that we can pass down through the family forever seemed to make sense at the time. Even though we didn’t have the cash to pay upfront they gave us credit. We’re due to make our first payment on the 24th of November. Now we’re back home in the UK I am having serious second thoughts about it. I’ve seen so many bad reviews, I’m worried sick about what we’ve done. We’ve called westgate a number of times explaining how we were rushed into a decision and would like to pull out and take some time to think things over, but they just don’t listen. We’ve also spoken to the closing officer who simply tells us to give it a go, try it out and then if we are not happy she’ll help us get out of it by selling it on. But if it’s as bad as what I’m reading there’s no way we’ll get a buyer. Is there anything we can do?

    1. just as an FYI, Florida has a 30 day time frame where you can get out of your real estate transaction, like when you buy a car in the US, if within 3 days you change your mind, you can take it back. The same principle applies to real estate transactions in Florida but it MUST be done before 30 days has passed. Send a certified letter to westgate, something that shows a signature that they received it stating that you want to terminate this purchase. look in the fine print of your massive book they gave you to find the exact verbage and timeframes. By law they must tell you how to terminate, then you can google a form letter of whatever it is technically called. Hope you get this in time.

      1. Cooling-off’ period

        Contrary to what many people believe, there is no automatic right to cancel a legally binding contract once there has been a valid offer and acceptance. The right to cancel a contract is called the “right of rescission.” Generally, only certain types of contracts are required to come with a right of rescission.

        For example, with some exceptions, Florida law does allow a “cooling off period” or three-day right to cancel a contract for certain services to be rendered on a continuing basis, or on contracts for the sale of goods or services sold during the course of a “home solicitation sale,” which is a sale that takes place in your home or at a location that is not the main or permanent place of business for the seller, so long as the purchase price is more than $25.

        If you have any questions about whether you have a three-day right to cancel, contact a consumer agency, such as the Attorney General’s Office, the Florida Department of Agriculture and Consumer Services or your local consumer agency.

        If a contract provides a right of rescission, then in order to cancel such a contract, you must give written notice of cancellation within the time provided by the contract or by law, and it must be in the form required. A lawyer will be able to tell you if a particular contract comes with such a right to cancel and, if so, how to cancel. Be very careful to follow the specific instructions on how to cancel such contracts or your attempt to cancel could be considered invalid.

        Do Westgate provide a right of rescission on their contracts?

        1. Westgate doesn’t need to provide a right of recission. The right to cancel a timeshare contract entered into in Florida is provided for under the Florida statues, which Westgate is bound by:

          Title XL REAL AND PERSONAL PROPERTY
          Chapter 721 VACATION AND TIMESHARE PLANS
          SECTION 10 Cancellation.

          721.10 Cancellation.—
          (1) A purchaser has the right to cancel the contract until midnight of the 10th calendar day following whichever of the following days occurs later:
          (a) The execution date; or
          (b) The day on which the purchaser received the last of all documents required to be provided to him or her, including the notice required by s. 721.07(2)(d)2., if applicable.
          This right of cancellation may not be waived by any purchaser or by any other person on behalf of the purchaser. Furthermore, no closing may occur until the cancellation period of the timeshare purchaser has expired. Any attempt to obtain a waiver of the cancellation right of the timeshare purchaser, or to hold a closing prior to the expiration of the cancellation period, is unlawful and such closing is voidable at the option of the purchaser for a period of 1 year after the expiration of the cancellation period. However, nothing in this section precludes the execution of documents in advance of closing for delivery after expiration of the cancellation period.
          (2) Any notice of cancellation shall be considered given on the date postmarked if mailed, or when transmitted from the place of origin if telegraphed, so long as the notice is actually received by the developer or escrow agent. If given by means of a writing transmitted other than by mail or telegraph, the notice of cancellation shall be considered given at the time of delivery at the place of business of the developer.
          (3) In the event of a timely preclosing cancellation, the developer shall honor the right of any purchaser to cancel the contract which granted the timeshare purchaser rights in and to the plan. Upon such cancellation, the developer shall refund to the purchaser the total amount of all payments made by the purchaser under the contract, reduced by the proportion of any contract benefits the purchaser has actually received under the contract prior to the effective date of the cancellation, as required by s. 721.06. Such refund shall be made within 20 days of demand therefor by the purchaser or within 5 days after receipt of funds from the purchaser’s cleared check, whichever is later.

          Under Nevada law, I believe the timeframe is only 5 business days. So a purchaser would be best advised to consult the statute for the particular State in which the contract was entered into.

    2. Honestly, it really isn’t as bad as people assume it to be. It’s like the media(in this case the reviews you’re reading) they only have negative things to say about the deal, perhaps cause they were too caught up with a bad aura the entire time they were there. Whereas you state it seemed like a good idea, because it truly is. The company itself, with no good review, would grow to become the powerful engine it is in this industry. Don’t allow the negative to cloud your own gut decisions. Naturally, gut decisions is what makes the world a better place. It’s divine.

  18. We kind of got a time share last month but we are suppose to make payments on the “down payment” before we actually start making payment on the timeshare. My question is if we never make the payment to complete the down payment will they be able to consider us owner of a timeshare we never actually completely purchased? At this point I rather not pay the deposit with hope this gets us out of the contract.

  19. I cannot believe they allow these scum bags continue to rip off the public. I paid mine off within the first few months and that was the worst decision of my life. I recently retired from the military and it is a shame that those scammers are protected the law and we are not.

  20. I purchased a timeshare almost 10 years ago at Myrtle Beach, SC. Since our divorce my ex has been paying but he is tired of paying the monthly fee along with the HOA fee that continues to increase. When he called Westgate he was told that even though I signed an affidavit years ago to remove my name; we are both still responsible. Westgate says that both our names are on the deed and it will ruin both our credit. Now he wants me to help pay! Please advise what or who you suggest to talk to. Is sellmytimesharenow.com reliable? We purchased last year and every month we get a call and all they want is more money. took out first vacation and they stuck us in a hotel on campus and we still paid over 500.00. I am furious as this company is a scam. I haven’t stopped paying yet as I don’t want my credit affected. any advice would be greatly appreciated

    My husband and I have are “owners” of one week at newport beachside hotel and resort. When we bought it, it was stablished that it would be under Westgate name. In other words, at the time I bought it, newport was part of Westgate resorts, but for some management reasons, they became independent, problem is that I was already owner of that week. For your information, I bought this week because it was part of westgate and I could always exchange it to whichever that was near my house in ny. Since then, I had been forced to deposit my week using interval, which means paying interval for every year and for the exchange. This is a lot of money, I have tried to look into other option but have had problems and always go back to the same issue. To make story short, now they are owing us the 2014 week and this one because I have not been able to afford interval. In August this year, I called and requested my week, spoke to a lady Martha, she refused to give me the week of Christmas which is the week we are off from work. Once again, I’ve been forced not to use my week. She gave me a week in Orlando instead, which is a “Westgate” resort, and charged me $200+ for it. Did I have other choice, NO. So I paid once again….Now, at the beginning of September, we called and asked to please change it to a “Westgate” near to ny, perhaps Virginia so I can afford it (I’ll be driving there, instead of airplane). Well, it took them another week or two to tell us that there was nothing available in Virginia and that the one in Orlando was cancelled. What am I supposed to do now? So we requested anywhere in “Westgate” close to NY where I could drive…..They are giving me the run around, time pass by and they still have not respond, they pass me from one lady to another with not help, I will loose the 2014 week because of their monopoly business, CAN YOU HELP ME?

  23. My ex husband and I purchased a westgate timeshare in orlando,fl in 2013. We havent use it yet because we could never get the week we needed. Now we are going through a divorce and neither can afford it separately and wish to sale it. This is a nightmare! I wish I would have read these commits before I paid Sell my time share now. I am now 2 months behind on payments and really don’t know what to do. I email them for a Deed in Lieu of Foreclosure and they sent me a application for assistance and requested we send in pay stubs, back statement and tax return. Do anyone know if this is legit or not? I am reluctant to send them all this information. We didn’t need all this info when we purchased. If I decide to do what many are doing and not pay and let them foreclosure I want to know have they ever garnished anyone’s wages? That will be all I need especially going through a divorce and on my own again after 11 years.

    FYI…. I am hearing it it nearly impossible to get rid of a time share. I would hate to ruin my credit when I worked so hard to build it up.

Exactly the same thing happened to me and my family. We were on vacation in Orlando and signed a contract after an 8hours process on 28th April 2015.. Whe we arrived in Brazil we started paying the mortgage and were happy with the purchase, thinking that it was a great deal.. But then a really bad economic crisis started going on in the whole country, specially in my city and there is no way we can afford it anymore. So we started calling westgate about one month ago trying to cancel the contract and explaining we couldn’t afford it anymore, but we were told that there is no way to cancell it after the 10 days period.. the only chance would be transfering the “property” to another interested person, but they don’t help us finding this purchaser.. and now we really don’t know what to do!! I’ve already called my bank (brazilian bank)and cancelled any debit in my credit card related to Westgate and it has worked so far.. but I’m also worried about my credit in the US ’cause I’m planning to do research and moving to the US for about a 6-year period within a couple of years and it’s not a good idea to have a bad credit!!
    a brazilian westgate staff told me that once you have an unpaied debit your “bad credit” will ALWAYS be counted in the records and it wouldn’t be possible to do any type of loan anymore.. is that truth?
    IS THERE ANYBODY WHO COULD HELP ME SOLVING THIS PROBLEM PLEASE????? I reallt appreciate this.

    1. I think it is unlikely that Westgate can do anything to you, particularly if you are not a U.S. citizen and you do not have a U.S. Social Security number. They cannot trace you financially. I would suggest dealing only by e-mail and let them know they will not get another penny from you. Demand a “Deed in Lieu of Foreclosure.” They may send that to you, but if they don’t just tell them to pound sand.

      If you have any kind of credit reporting service in Brazil, check it and see if Westgate even appears. It may very well not.

      You might also want to post your question at Timeshare User Group, tugbbs.com. These people are timeshare owners, but they hate Westgate. They might be able to give you some additional advice.

Then I was promised things that NEVER happen…Then I was lied to…My loan was suppose to be for 5 years and her it’s 10 years…I’m not sure what to do…I haven’t slept in 2 days on what is the right decision. I signed new contract on 28th of July 2015 after more than 10 hours between the presentation, showing the resort(Florida) and talking about prices, conditions of payment, horrible food and etc. First sight, is the best thing in the world, just when we came back to London, UK, i decided to search about Westgate and i found horribles comments. The 10 days is gone and now i am locked in this jail. I contact the Westgate regarding how i could cancel it and the person said: There is no way to cancel. I can be wrong but does not say nothing about to cancel after the 10 days, is this fair by law? I am thinking to ask my bank to cancel any payment to Westgate. Anyone has done it, even living outside of US? I do not care about my credit.

    1. My husband and I bought a Time Share in 2007 at Westgates Lakes in Orlando. After making the down payment we religiously paid our monthly fee. We were unable to book our first week due to availability and stayed about two times thereafter. On our 1st visitT hey tried and was persistant to sell us an upgrade from every other year to a twice a year visit in one of their newer built units. We explained that this was not in our budget. We were then tagged teamed by the rep and a another who seemed to be a supervisor. They were even getting upset with us trying to make it seemed that we were so stupid not to see the deal they were offering. After mounting up maintenace fees in 2010 that kept increasing we wanted out. They suggested and asked if we knew anyone we can sell it to but never offered to assist in selling it for us. Its funny that they found us to sell someone else’s unit to but seem incapible of finding another fool to buy ours. I do not even think we ever got an official deed. They made threats of foreclosure and said it would affect our credit score but we wondered about that seeing that we are not from the US but from the Bahamas. We refuse to sign anything they sent and we have stopped paying for years. As of last year emails still suggests that we are Westgate Owner??? Seemed like someone did not get the memo.

  27. We are all paid up but can not use the timeshare as all trades are far from our kids who are now grown. I was thinking about donating my weeks to homeless people. The looks on their faces would be PRICELESS. They can not discriminate. It would give the homeless a nice place to stay for a week. 🙂

  28. I too bought a Westgate Timeshare in 2008. I have been trying to get out of that timeshare since I got in to it. I even tried to sell it, but couldn’t find anyone who wanted it.I stopped making payments March 2014. They finally sent me a deed in lieu of foreclosure this year. I signed it, but not sure if that releases me of any future payments. They offered to upgrade me and put me in a better contract with lower payments/maintenance. I personally do not want anything else to do with them. Nice resort but not worth the price. They still call me from time to time. As far as i’m concerned that is their timeshare now. I will never buy another… What a nightmare…..

    1. So…you stopped making payments in 2014 and they still sent you a deed in lieu of foreclosure ? Mine is paid for but I didn’t pay my maintenance fees that are due this year and requested the deed and they had a foreclosure company send me a letter!

      1. I did that last week and They called me back and refused to give me the deal of the deed and instead of foreclosure but maybe you have to put up with their nonsense for a year before they send one .

  29. Hello, I was wondering if anyone returned the Deed in Lieu of Foreclosure along with the payment asked. I got the letter a couple of days ago along with a fee of $1,000. I called today and they told me if I don’t return that, then they will proceed with FORECLOSURE. I read some comments from people who returned the DILF and said that Westgate still went back to charged them money and were reported to the credit bureau. Does anyone has any advice? I stopped paying a year ago, I still owe $7,800 but I will not PAY one more cent! I already payed more than $5,000 and like many owners, I was cheated, I was taken advantage of while in Vegas by being offered the Towers, days and many other things. I ended up buying in Florida with the promise of being able to use the Plate Hollywood Towers which of course that never happened, I was never able to book ANY VACATION within the 4 years I was paying my ‘MORTGAGE’ and ‘Yearly fees,’ I’m at a point where I am feed up and will not give them my hard earned money to this SCAM!!!! Please any ADVICE?????

  30. We had a timeshare with Westgate and it was a nightmare from the get go. We tried using a exit team to get us out and that was a pain in the neck. so we started checking out timeshare attorneys and found Aaronson Law Group! I contacted them and liked what I was hearing so they took over my case. In about two and a half months they had gotten my timeshare taken care of which included documentation, recension, and credit restoration. It was painless and non expensive procedure. If your in a similar situation as I was I recommend checkout Aaronson Law Group and see what they have to say about your specific timeshare issues. Hopefully this helps someone in need!

      1. Im sure about greg47. But my husband and I also used them and it cost us around $2000. It was well worth it. I think they sort of specialize on timeshare cancellation cause they have helped a lot of people get out of there timeshares. Im sure theres others out there too I just dont have personal experience with those guys to tell you whether they are good or not! Hopefully this helps because I know what kind of nightmare it can be dealing with a bad timeshare!

      I read what you posted about timeshare. We are residents in the UK had bought out timeshare about 7 years ago. WE have also tried to contact westgate to terminate our contract but they do not want to know. I have contated the lawyers that you said you used. They have said that they can deal with my matter and have quoted some USS$1,950.00 for court fees and US$1,450 for their costs. Is this what you paid to them.

  31. I am also a westgate timeshare owner. Bought it while vacationing in Florida. We live outside of US halfway round the globe. Already paid the full sum of like $10.5k + first maintenance fee. Got calls in the middle of the night from some companies who knew every detail of my ownership to help me rent it out with a fee. Good thing didn’t fall for it. This happened twice over 2 years. When I checked with Westgate, they said they don’t engage anyone else to help us rent out our unit. So it makes me wonder how those guys who called knew everything about my ownership. I want to get rid of this ownership but based on all that I’ve read, there is just no way to rid of it. If there is a class action suit, I’d be glad to join, that is if the suit can get us money back after paying the class action lawyer. In the meantime, should I change my particulars on file like the address and contact numbers to avoid harassments?

    1. If the timeshare is paid for you might be able to write Westgate and get them to take it back. If you do so, you have to be persistent as they may not grant you your request the first time.

      Since you are outside the United States, you can probably walk away from this albatross and not suffer a credit hit. However, they may still bother you for a bit, and you will certainly not get your money back but you won’t even if you can give back your timeshare anyway). Best of luck!

      1. I’m at Smoky Mountain Resort now. Our room has had nothing but issues for four days now, they’ve moved us and now even more problems. We’ve owned since 2007, it’s paid off. We just asked them to take it back. They are charging us $500 to draw up the paperwork, but I will never have to pay another penny in maintenance fees or fight to get a reservation! I will also be saving our A+ credit rating! I will eventually come out a winner by helping others not buy into timeshares and not giving Westgate anymore money by telling them to run from these vultures!

My husband was called last November by a so called company that tried to get us to sign 7K for them to sell our 52 weeks of timeshare units that we have and said they were part of Interval. We got a down in a price and never heard from them again. We have been so busy with life here that we really need to get more information. I too ask your question, how did they get our information where they knew everything about our contract?

  32. does it say in the contract that a owner has to go to the presentation. They said they were going to give us breakfast take us on a tour to see all they have done at Westgate Smokey Mountain Resort.
    Then with blaring music while we tried to eat and listen to them yell over the music tried to get us to upgrade from a one bedroom to six. It cost more than our house. The manager came back three times
    we kept saying no. Finally I said I am done. He didn’t even blink and asked if I had learned anything. I was so angry he was about the age of my son and if it would have been my son I would have told him off. It is a scam, a rip off, lies after lies. Yes the resort is nice. I am payed up on everything but I want out. Maintenence fees keep going up. Is there any way out.

  33. It took about 4 years for westgate and the collection agencies to stop bothering me. they were very persistent for the first couple years with calls and letters. It’s been about a year since any contact and I don’t hear from them anymore. They threatened to ruin my credit but nothing was ever done to my credit and I still have a very high credit rating. I’m so glad I just walked away and I recommend that others have the courage to do the same. Timeshares are bad and should be illegal. the maintenance fees seem to be where they get there money. I think that now since so many seem to be walking away that the timeshare people can’t afford to do anything about all the people that have walked away.

    1. Tom there are Reason why some people have to get out of them being a few Divorces , Sickness , Hardship there should be reason to be able to get out of it without it hurting you . I paid the whole thing off in 2004 only stayed one night in my Westgate also had a hard time getting a place with them and you had to pay the $150 which went up to $500 to switch I tried to go to the mountain’s and they where super rude and then try to put that one on me . so I tried to sale it I had a buyer so they called to get all the details so they tell them on their week and any other place they go they have to pay $400 so I am a Owner why would I have to pay $500 the maintance fees have double you can take a great vacation of your choice without Westgate . sorry to vent but I am in the same boat as you Christina

I have been ignoring the 100’s of phone calls a week, threw away letters, etc. Westgate has never shown up on my credit report and it still, to this day, has not popped up. I received the Deed in Lieu of Foreclosure last week. Some people have said to sign it and send it back with NO money and they will eventually process it and leave you alone. Have you ever received the DILF?

      1. I don’t remember that, but then again I could have thrown it away without opening it. Did it come USPS? A special delivery I probably would have opened out of curiosity but I don’t remember getting anything like a DILF.

  34. I also bought a timeshare after being held for 6 hours by these scamners. I am on 20th day and Late to cancel.
    I am not going to send them a dime
    what are the consequences. This is a document that was signed in duress and rushed in to us. They lied to me I am dealingwroth “state of Florida personel” did not advice me on cancelation procedures.
    What are the consequences.
    Can state do anything?

    1. I have the issue. We bought it on June 19 and they did not tell me how many days I Can cancel it. We come home and Reilly that it we had 10day. We sent the certify letters to cancel on July 9 along with the package they give me. They charge my cadit card for first month. I should cancel my credit card before they do that. They lie to me. I am not going to sent any penny. I don’t care if I have bad credit. If you give your bank or credit card make sure to cancel it all.

    1. Hi I haven’t paid maintenance for over 10 years . I have 2 timeshares all paid off at the time I brought them . Just ignore the maintenance calls and letters . They have now sent me a warranty deed in lieu of foreclosure so they can gladly have it back and I will sign it over .from a credit score in UK they can’t touch you here

    3. I’m all for it. Own Smokey Mountain free and clear, but they kept changing things and all the reasons we bought, they no longer have. Bought in 2006 and husband passed away in 2008, I can not keep paying the yearly fee and have not used but a total of 2 weeks in all that time. I moved back to Florida to be near family and the ones they have in Orlando are crap compared to what I bought.

  37. We have had timeshare with Westgate since 2005, we have upgraded twice and on the second occasion tried to cancel within 14 days which is the normal time we were lead to believe. When we got back to the UK I rang the agent who said we were out of time.

    We paid for the TS off within six months.

    I have written asking them how we can cancel our ownership and they have not replied.

    We live outside the U.S.

    All maintenance fees have been paid upto date.

    We have tried to sell and got ripped off, thankfully because I used my cc they repaid the money.

    Can you help us get out of this contract.

      The instructions are in the fancy binder they gave you, in a hidden pocket, but just write a letter to them. Send it USPS Certified, with Returned receipt.

      As long as you are within the legally allowed time period, you’ll be released.

      Send your rescission letter by certified mail today, so that you have documentary proof of postmark date. Do not fax, do not call, no emails, do not use FedEx or UPS.
      No smoke signals, no carrier pigeons, no hand delivery, no bicycle couriers. None of those avenues are acceptable or legally adequate. Use only certified mail and save your date-stamped USPS receipt for future reference. Keep a photocopy of your rescission letter (which should be signed by all parties who signed the original contract) and also make and keep photocopies of any and all other contract materials too — just in case Wastegate later tries to play games or make false claims about your compliance with rescission instructions and / or applicable deadline.

Now the biggest problem is the maintenance fee, every year without fail arrives just before Christmas.   39. I paid $6,500 for Westgate’s Vacation Club. I can never book any of my 4 promised weeks because they are allegedly already booked up. It looks as if there are MANY people that have been scammed by Westgate. There has to be some power in numbers…… I wish there was a way to join together and file a lawsuit against them. I just want my money back, and to expose this company, so that others are not cheated out of their hard earned money as I was. I actually just spent a few hours of my last vacation standing in the lobby of a Westgate resort and warning the people I saw walking through with a salesperson. Hopefully, this saved these people from making the same mistake I did. AND the look on the salesmen’s faces was priceless! If enough people join together and speak out, maybe something can be done.

We just recently purchased one, and i call the customer service line and they were trying to talk me out of cancelling it. they said i needed to get in touch with my closing officer. so i spoke to him and said i wanted to cancel it. he said fine ok i will get a letter of confirmation in the mail. I still felt uneasy so the next morning i wanted to send a letter just in case. i called the customer service line again and asked for the mailing address. they would not give it to me and told me to contact my closing officer. Five minutes later i recieved a phone call from a very upset man saying i was putting his job on the line calling customer service. he said he was going to help me but he said since im reading all these reviews on line i should be able to get the address from on-line as well he also stated normally cancelling i would get penalized he said he was going to help me with that but since i was bothering customer service he would no longer be able to help me with whatever fees i would be charged. i am so upset i dont know what to do. he then hung up and said he had another call. please help me. Tuesday was the day we signed the contract. how can i ensure i will cancel in time?

  42. Hi, we are Westgateowners since 2008. We stopped paying in November 2013. We cancelled our Credit Cards. Since then, they have harassed us non stop by email and by phone. We have never answered to their messages. Today, I have received to phone calls and they did leave message that they have sent us a Warranty Deed in Lieu of Foreclosure. What should we do when we receive it? Pay the processing fees? We are from Canada. Any advice would be appreciated!Thanks

They did send us a form to fill out our financials and we have not, nor will we be filling it out (they actually want medical records and pay stubs etc lol). We are also from Canada.     4. I’ve read on several other forums where people have filled out the Warranty Deed in Lieu of Foreclosure & returned it without paying any fees. They never heard from Westgate again. I would not send them another dime. Fill out the form, return it & ignore any calls or emails. I’ve had mine since 1998 & stopped paying them last year. Sounds like I’m not the only one.

      1. I received the DIL form and have gotten it notarized. The fee on it says $0.00 and actually states that they will take the property back from me in consideration of $10 paid to me. I have not sent it back yet as I am going through some financing for a business right now but will be sending it back as soon as that is finalized.

        I have not made a payment since December 2013 and nothing negative has shown up on my credit report. I sent them a long letter explaining why I was no longer paying and sent the same letter to their attorney. I have not received a call in over 6 months. In my letter I touched on many of their illegal sales tactics like stating that they had inside information with Disney that they were building 2 new parks in the next couple years. That was 5 years ago.

        In 2012, I was given the same exact line as someone tried to upgrade me. The resort was wonderful – I am leaving due to principal. They lied to me about when/how I could pay my timeshare off and when I tried to pay in full I was laughed at by a sales person. Later, after I stopped making payments I was told I should have called in to make the payment instead of speaking to someone on the property. That should not matter – I can only go by what their representatives told me. I spoke to 2 different people and was told the only way to pay it off in full was if I purchased a full ownership instead of an every other year ownership and that I wasn’t even a real owner yet so they couldn’t do anything. I’m rambling now and getting worked up… I haven’t thought about this in awhile – time to stop, but wanted to comment. I have been told by others that when Westgate reports, they only report to one credit agency so it only changes one score and most banks will use your mid score anyway – I do not know that for sure, but thats what I have read in my research.

I been having a hard time with them to I send them a note stating that I was Divorced no longer going to pay the Maintance Fees my ex will not even talk with them so they are calling and harasses me. she called this morning states she got my letter there is nothing can to help me she says sale it I told I did but they aren’t giving apple to apple they told the girl from Westgate told me that if they wanted to buy it they would have to pay $400 for where they wanted to go also for there time at the own Time share on their own week it would still be 400. Seems a bit unfair to me what was bought should be the same as the next someone buys off you . I am totally frustrated

  43. I need help badly! My family and I were on vacation when we signed up for Westgate! We got overly excited and regretted it right when we got home, that was last Saturday 09/27 and I called that Thursday which was only 6 days. We haven’t even made a down payment and our first monthly payment comes out October 27. I called to cancel and they said they were sorry you have cancel within three days? Is that true or can I still send the letter in within the 10 day period? Also if we close our bank account and decide not to pay, will it go against our credit? Someone please help, I don’t want this debt on our record in anyway!!!!!

    1. I am going through the same thing its a waste of money you can’t get to go anywhere without it costing you more money … BIG WASTE so sorry you bought into it . Just remember there is a lot of us going through it together

  44. I just bought one. And it is great. I’m not in anyway affiliated with Westgate.
    I didn’t want my wife to sign it and then it dawned On me that we can make
    $100,000s of dollars off these vacation packages.

    If you want out. Here is the fastest easiest way.

    1. Be current with your payments and tell Westgate you are gonna sell you $69,000
    1br for $2000. They don’t want people getting this that are poor and don’t represent
    The company well. Brings down the value of the Timeshares.

    2. Make a website as a travel agent and sell the vacations you can get at $49 for $499
    or any rate where you make money from them. They will cancel your account so fast

    Then you won’t get a foreclosure letter or anything. They just take it back from you and
    your out!!!

    Try that people.

    1. Great idea. We should all get together and schedule our weeks to be used by the local homeless shelter. I wonder what Westgate Town Center in Orlando would say about that?

  45. My girlfriend and I stayed at WestGate resorts in Florida a couple of weeks ago and were talked into purchasing a timeshare for $9,000 $0 down. We decided that night that this purchase was a bad idea. Woke up the following morning and told the salesman that we wanted to cancel. He told us that he will take care of it. We received our westgate credit cards today but no contract. I read something about having a certain amount of time to cancel once we signed the contract but when i call the salesman he tells me that he can not tell us what to do until we receive the contract in the mail.

    What should we do from here to cancel our timeshare?

    1. Please all those who have been ripped off by Westgate, someone check to find out how we can file a Class action suit against them for their unfair & deceptive practices. I am looking into it as well.

        1. You guys need to contact a timeshare cancellation lawyer! There are all kinds of class action lawsuit going on right now! Do some research and talk to some and see what they say. I dont know all the ways to get out of timeshares but I do know there are some good attorneys out there who can help!

      1. I stopped paying the HOAs and the monthly payments… they call me like 12 times a day trying to collect. I just want out. I will need to send them a letter. We cannot afford the payments as I am the only one working and have 3 mouths to feed. My husband has decided to go back to College. If anyone knows of a class action suit I want in!         1. I own at Westgate Gatlinburg. My husband and I also recently decided to stop payments 2 months ago. I have been ignoring the phone calls and emails. I agree that everyone needs to take a stand and collectively as a group stop payments.

          1. I’ve paid faithfully since 2006, I have recently fell on hard times which makes it impossible for me to continue paying for something that is never available for me to use. I’ve reached out to West Gate thinking that they would understand, but I was wrong. I am vowing to stop all payments today, hopefully this doesn’t ruin my credit, but I have know other choice. This Company has no integrity. Please Advise!

          1. count me if there is an ongoing law suit. I am on the phone with WG and they are refusing to assist and explaining in full detail that I could no longer afford this property and NO LONGER WANT IT. My company is letting people go due to finances this WG person on the phone kept giving me a payment option. How can I pay if I’m going to lose my job. WG said I’m not eligible to sign over deed bc “I’m not paid out”. Really. Rip off company!!! Need help.
